News: New Background for The Red Raven

Dear Readers,


I have just updated my blog’s appearance.
I changed the wallpaper to a more appropriate wallpaper to match the blog’s theme.
I call it Huginn and Muninn.
I hope it scares the shit out of you and I hope it matches “The Red Raven” that much.
It’s optimized for widescreen monitors some of you guys (especially those using a 4:3 15inch monitor) might see the raven on the left cut off but if you are using a 16:9 (whether 15inches and above) widescreen monitor you can view the way it is.

NEWS: Rise of the Red Raven.

Dear Readers,


First of all, I would like to thank all of you who have been enjoying and supporting my poetry blog all this time. In the past few days, I have decided to make changes to my poetry blog for personal and spam reasons.


Lately, I have been receiving quite a number of spam comments about some random products ranging from leather bags to computer chips and a bunch of other stuff like that. Thanks to Akismet spam filter, I was able to filter out the spam from going to the pages in my site. Akismet has been doing an excellent job catching these spam for me but it annoys me to see a number of spam from Akismet’s net then deleting them every time I see them. So, I have come to resolve to change the address to buy me some time from these spammers. I know this is a temporary solution to a permanent problem of cyberspace but I also had personal reasons to, so, I went ahead with it.


As you can all notice, I have changed the theme of my blog from the funny looking doom shroom background to this spooky somewhat creepy night moon with dark clouds background with the crow perched on a chest header.


I have also decided to change it’s name from the old “Cyber Mushroom” ( to “The Red Raven” ( also to mark my new journey in life. This is to show to everyone my true colours. For, I am like the Crow or the Raven, who, though the most intelligent of all the avian species, is always stereotyped, misjudged, and misunderstood for his appearance. I want everyone to know that for me, even through everyone’s stereotyping and prejudice, my life will go on. I know who I am and I will stay as real as I can for the rest of my life. I don’t care how everyone sees me, whether you find me mysterious, enigmatic, creepy, and the latter, I will not pretend to be someone who I am not just to gain anyone’s acceptance nor anyone’s attention. I am me and no one can change who I am. This is me. Like the Crow, I will perch on tree cawing, I will spread my black wings, and won’t give a damn if I scare the shit out of everyone by doing so. This is my resolve.


You might be wondering why “The Crimson Corvus” or “The Red Raven” is the name I chose because obviously there is no species of Crow of Red plumage.


Well, my favourite colour is Red so I thought of the idea of the carrion crow having it’s black plumage with its purple iridescence when light strikes it and came up with my own mythological crow, “The Crimson Crow” or “The Red Raven” who has black plumage like any other crow or raven but instead of the purple iridescence effect he has this unique red iridescence. I imagined that since the lot of people find me so different, that this name would be the most appropriate.


I hope you will all enjoy the changes I made and I hope you will all continue to support my poetry in this blog site. Thanks again for all your support. I will keep on writing stuff to touch your hearts, make you smile, and even scare you. The old Cyber Mushroom can now rest in peace.

NEWS: Cyber Mushroom Now has a new Theme!

Dear Readers,

I have just updated my blog and changed its theme.
I changed it to “Motion” Theme and added all the same old features back.
I also included a background image for a more enjoyable time in my site.
I hope you enjoy it! The color of the background, I believe is green as a friend told me it is green, but I am really not sure as I am color blind. So, please comment if it is not green. I want to make it green because a friend told me that green is relaxing to the eyes and I want all you reader to have a relaxing time while reading stuff in my blog (that is one of the reasons I added the Chill Music on the side).

Libel on the Internet under Philippine Law


To all you libelous slanderers, who keep on commenting to my posts, who are either friends or relatives of my ex-wife, please be informed of this Law that I am posting here. May this educate you. Please also take note that your comments are very well kept safe on akismet’s spam box (ready to be made public at the click of a button) and that I know exactly where you are and I can very well identify you even through all those proxy addresses and ISP redirects you and your proxies used. Good thing that I am not as childish as you people and I know better than get intimidated by your funny childish acts hahahaha. You people are so ridiculous, really, to be honest, your posts make me and my friends laugh hahahaha. damn, you really suck. hahaha!

This is but a friendly reminder from this Blog and it’s author. Make no mistake, this is not a threat. hehe 🙂
Unless some loyal friends out there decide to make a move for me. have a nice day. 🙂

Libel on the Internet under Philippine Law

First, the disclaimer. This is not intended as lawyerly advice. Neither does it refer a specific case or circumstance. Much less can this be considered as an offer to provide legal services or to advocate anything. It’s just one person’s opinion on a matter of increasing interest to bloggers and other denizens of cyberspace: what constitutes internet libel in the context of Philippine laws.

How is libel defined under Philippine laws ? Article 353 of the Revised Penal Code defines libel as “a public and malicious imputation of a crime, or of a vice or defect, real or imaginary, or any act, omission, condition, status or circumstance tending to cause the dishonor, discredit or contempt of a natural or juridical person, or to blacken the memory of one who is dead”.

For an imputation then to be libelous, the following requisites must concur: (a) it must be defamatory; (b) it must be malicious; (c) it must be given publicity; and (d) the victim must be identifiable.

If you call someone a scum-sucking, slimeball, swindling pimp, even if this is fairly accurate, and post it online, you may be sued for making libelous statements.

Defamatory words are those calculated to induce the hearers or readers to suppose and understand that that the person or persons against whom they were uttered were guilty of certain offenses, or are sufficient to impeach their honesty, virtue or reputation, or to hold the person or persons up to public ridicule. Philippine law also presumes every defamatory imputation to be malicious, even if true, if no good intention and justifiable motive for making it is shown (Article 254 of the Revised Penal Code). Malice exists when there is an intentional doing of a wrongful act without just cause.

The libel must be given publicity, circulated or publicized. Postings in a forum, message board or blog can certainly be considered as publication. Lastly, the victim or offended party must be identifiable.

What would be the liability of service providers for libelous acts committed by clients ?

Under Republic Act no. 8792, otherwise known as the
Electronic Commerce Act, a party or person acting as a service provider incurs no civil or criminal liability in the making, publication, dissemination or distribution of libelous material if: a) the service provider does not have actual knowledge, or is not aware of the facts or circumstances from which it is apparent that making, publication, dissemination or distribution of such material is unlawful or infringes any rights; b) the service provider does not knowingly receive a financial benefit directly attributable to the infringing activity; c) the service provider does not directly commit any infringement or other unlawful act and does not induce or cause another person or party to commit any infringement or other unlawful act and/or does not benefit financially from the infringing activity or unlawful act of another person or party (Section 30, in relation to Section 5, E-Commerce Law)

Hence, a service provider should not be held liable if he has no actual knowledge of the libel, does not benefit financially from the unlawful act or does not directly commit the libelous act or induce someone to do so. Of course, once the service provider gains actual knowledge of the libel, timely steps must be taken, within the service provider’s authority, to remove the offending material by warning the perpetrator and, if all else fails, terminating the offender’s account. By acting speedily on the matter, the service provider shows good faith and that it does not condone the libelous acts.

A fundamental sense of fairness and simple good manners and right conduct is usually enough to keep you, a good netizen, out of trouble.

Share a YouTube video? Go to jail?

Dear Reader,

Ever sent someone a link to a copyrighted YouTube video? Of course: Everybody has. And now the US Government seems to think that means it can put us in prison.

Bryan McCarthy ran a website,, that linked to various websites where you could watch online streams of TV shows and sports networks. A couple months ago, the government seized his domain name and just today they arrested him for criminal copyright infringement.

Tell the government that this is crazy: There’s nothing wrong or illegal about sharing a link.

The government doesn’t even allege he made a copy of anything! Just that his site linked to various sites with copyrighted material. Under that sort of thinking, everyone who’s sent around a link to a copyrighted YouTube video is a criminal.

This is another shocking overreach by the department of Immigrations and Customs Enforcement (ICE) — a steamship-era department that’s proving once again it doesn’t understand the Internet.

We need to push back — and fast — before they try to lock up all of us. Click here to tell ICE to drop its charges.

84,000 websites seized?

Dear Reader,

The government is feeling the heat. For months, Immigration and Customs Enforcement (ICE) has shut down blogs and search engines that weren’t involved in any crimes. And then a couple of weeks ago they managed to take down 84,000 sites completely by accident.

Click here to tell ICE that they need to stop abusing their power by shutting down these websites.

ICE’s flubs have made it clear that they have no business wielding this much power over the Internet. Now ICE is feeling the pressure, and its director knows he has a public relations nightmare on his hands. In an unusual step, John Morton gave an interview in which he tried to justify the seizure policy: “We can seize and forfeit [websites] just like we seize and forfeit bank accounts, houses and vehicles that are used in other crimes.”

But ICE is taking down websites of people who aren’t guilty of any crimes, and in so doing they’re undermining Americans’ basic free speech rights.

Will you tell ICE that they need to end their website seizure program right away?

Wiretaps on Telecommunications? Outlaw Skype and other Telecom companies??? What the F^(\<?!

Dear Reader,

Skype, BlackBerry, and other Internet communications services are under attack! The Obama administration and the FBI are pushing legislation that would ban online communications technologies like these unless their developers make it easy for the government to wiretap them.

The Communications Assistance for Law Enforcement Act (CALEA) requires telecom companies to make it possible for the government wiretap their networks. Now Obama and law enforcement want to expand CALEA to cover all online communications technologies, including peer-to-peer and social networking apps. The New York Times says the law would even include making sure the government could intercept and unscramble encrypted messages.

Click here now to tell Congress to protect services like Skype and reject the FBI’s expansion of CALEA.

Companies that want to avoid stifling regulations, and those that actually care about our privacy rights, would have to leave the U.S. That’d reduce our prominence as a technology leader, and encourage the government to devise ever more heavy-handed ways of blocking Americans from using the offending technologies. Other companies would comply by creating back-doors that could lead to more privacy violations and make the Internet more vulnerable to attack: experts say wiretap-ready technologies would be much easier to hack.

An expansion of CALEA would be a tremendous blow to a free and open Internet. Lawmakers need to reject it: Will you sign our petition demanding that they do so?
